Terms and Conditions
Section I. DEFINITIONS
Event: The drawing event you have chosen to purchase a ticket for at a specified venue Payment Method: the method you have chosen for your payment for the Event that you indicate during your registration
Participant(s): the person who has purchased a ticket to attend an event
Venue: the location where the drawing event is being held
Ticket: a revocable license sold to you for which you have paid
Section II. HOW THE CHARCOAL EXPRESSIONS SERVICE WORKS
Materials Provided: All materials including drawing equipment, aprons, paper, mat-board, and clean-up supplies are provided by Charcoal Expressions
Start/End Times: Charcoal Expressions will make every effort to begin and end at the designated times; however, outside factors may cause these times to vary slightly and the exact amount of instruction time at each event may vary. Consider arriving earlier if planning to purchase food or beverages from the venue to ensure readiness to begin at the designated start time.
Availability: There may be potential last minute venue changes or cancellations due to registration numbers or venue request.
Capacity Limitations: There are capacity limitations at each event based on venue size to allow for adequate drawing room for each participant. Charcoal Expressions recommends advanced ticket purchase and arriving at the event at least 20 minutes prior to the start of the event to claim a seat.
End Result: Every drawing will be different and unique. Charcoal Expressions makes no guarantee of the end result looking exactly like the original drawing depicted by the artist at the event or on the website.
Clothing: Charcoal Expressions encourages washable clothing and will not be held liable for damages to participants clothing.
Section III. AGE REQUIREMENT
The age requirement to participate in Charcoal Expressions drawing events may vary. Please view the information regarding specific events as to if an age requirement is in place. Venues with alcohol may require a minimum age of 21 years. It is the responsibility of the registering participant to ensure participants meet the age requirements.
Section IV. SOCIAL MEDIA
Participants can connect Charcoal Expressions to personal social media accounts (facebook, etc.). By doing so, the participant is consenting to their friends seeing that they were a Charcoal Expressions event participant, what they drew, ate or had to drink, with whom they attended, and any other information visible within the posted photos. Be aware of social media personal security settings related to this.
By registering for an event, the participant is consenting to photos being posted on the Charcoal Expressions LLC website and social media Facebook page and is consenting to these photos may also being used in marketing materials including, but not limited to, brochures.
Section V. EVENT CONDUCT/RIGHT TO TERMINATE
By registering for a Charcoal Expressions event, the participant agrees to conduct themselves in a manner which displays respect for the artist, customers and venue. The participant agrees to not interfere with the instructions as they are presented. The participant also agrees to not conduct themselves in a manner that is deemed offensive or vulgar by others.
Charcoal Expressions reserves the right to terminate or restrict the participant’s use of services without notice it, in the judgement of Charcoal Expressions LLC, participants conduct is causing a disturbance to others.
Section VI. UNAUTHORIZED USE
Charcoal Expressions drawings are developed by, and for, Charcoal Expressions. Except for the individualized participant event drawing, Charcoal Expressions drawings or any portion of them may not be copied or reproduced. Charcoal Expressions drawings, including the individualized participant event drawing, or any portion of them may not be sold, leased or distributed, except the individualized event drawing may be given to the individual participant, friend, or relative as a gift for that friend or relative personal use.
Section VII. PRIVACY POLICY AND COMMUNICATION
By registering for Charcoal Expressions event, participants are consenting to receive communications from Charcoal Expressions which may include future offers or promotional products.
Participants agree to using electronic communication related to purchase and information concerning or related to the event. If there are changes to designated times or venue or an event cancellation, notification will occur via electronic communication.
Section VIII. PROMOTIONS
Charcoal Expressions promotions may not be used with any other offers.
Participants may cancel their registered event with Charcoal Expressions at anytime. Charcoal Expressions provides no refunds or credits for unused promotional tickets.
Charcoal Expressions is not responsible for offers, products or services by third parties.
Section IX. BILLING
By purchasing a ticket to a Charcoal Expressions event, the participant agrees that Charcoal Expressions is authorized to charge a ticket fee at the current rate, and any other charges incurred in connection with the participant’s use of the Charcoal Expressions service to the payment method provided during registration. Please note that prices are subject to change with different venues and event dates.
Billing shall indicate either a charge or debit against the participant’s payment method. The ticket fee will be billed on the day the ticket is purchased and not on the day of the event.
Ticket fees are fully earned upon payment. PAYMENTS ARE NONREFUNDABLE AND THERE ARE NO REFUNDS OR CREDITS FOR UNUSED OR PARTIALLY USED TICKETS. Charcoal Expressions retains the right to provide a refund, discount, or credit to some or all of their customers. The provision of refund, discount or credit is at the sole and absolute discretion of Charcoal Expressions.
Section X. VENUE
At the event, participants may encounter third-party services including, but not limited to food and beverages from the venue where the event will take place. Charcoal Expressions is not responsible for and does not endorse the third-party services provided by the event venue. Participants are responsible for charges accrued from these services.
Section XI. INTELLECTUAL PROPERTY
Charcoal Expressions is a registered trademark of Charcoal Expressions LLC. The Charcoal Expressions logo and website are trademarks of Charcoal Expressions and cannot be used or reproduced without written permission from Charcoal Expressions and may not be used in connection with any product or service that is not affiliated with Charcoal Expressions.
Any photographs taken directly before, during or after a Charcoal Expressions event including the artist, assistants or event participants shall become the property of Charcoal Expressions and may not be reproduced or used except as authorized by Charcoal Expressions.
Section XII. ARBITRATION AGREEMENT
Charcoal Expressions and the participant, including all event participants for whom a ticket is purchased or who actually utilize a ticket, agree that all claims and disputes which arise related to this Terms and Conditions agreement are to be settled by binding arbitration in the state of Wisconsin or another location mutually agreeable to both parties. The arbitration shall be conducted on a confidential basis pursuant to the Commercial Arbitration Rules of the American Arbitration Association. Any decision or reward as a result of any such arbitration proceeding shall be in writing and shall provide an explanation for all conclusions of law and fact and shall include the assessment of costs, expenses, and reasonable attorneys’ fees. Any such arbitration shall be conducted by an arbitrator experienced in the entertainment small business industry and shall include a written record of the arbitration hearing. The parties reserve the right to object to any individual who shall be employed by or affiliated with a competing organization or entity. An award of arbitration may be confirmed in a court of competent jurisdiction.
